Terms & Conditions
Lawn Treatment Services Agreement – Lawn Therapy
Effective for all UK clients · Please read carefully before engaging our services
By booking or accepting any lawn care or treatment service from us, you agree to be bound by these terms and conditions in full. These terms govern all treatments carried out on residential and commercial properties throughout the United Kingdom.
1. Definitions & Scope of Services
“We”, “us”, or “our” refers to the lawn care and treatment company providing services. “You” or “the client” refers to the person or organisation booking the services.
Our services include, but are not limited to:
- Scarification and aeration
- Application of granular and liquid fertilisers
- Selective and non-selective weedkiller treatments
- Herbicide application for broadleaf and grass weeds
- Insecticide treatments for chafer grubs, leatherjackets, and other lawn pests
- Moss control and lawn conditioning treatments
- Overseeding and soil improvement programmes
- Lawn renovations
All treatments are carried out by trained operatives and, where required by UK law.
2. Chemical Treatments: Fertilisers, Weedkillers, Herbicides & Insecticides
All pesticides, herbicides, weedkillers, and insecticides used by us are approved for use in the United Kingdom and applied in strict accordance with the Control of Pesticides Regulations 1986, as amended, the Health and Safety at Work Act 1974, and the Code of Practice for Using Plant Protection Products.
Your responsibilities prior to treatment: You must inform us in advance of any known allergies, sensitivities, or medical conditions affecting household members or pets. You are responsible for ensuring all persons and animals are kept off treated areas for the recommended re-entry period stated on our treatment notification.
Typical re-entry periods are as follows:
- Fertiliser treatments: once dry, usually 1–2 hours
- Selective weedkillers and herbicides: 1–2 hours, or as stated in our aftercare information
- Insecticides: 24–48 hours minimum, or as directed by aftercare information
- Moss treatments: 24 hours minimum before irrigation or rainfall
We will provide a written treatment notification card or email detailing any specific post-treatment instructions. Product safety data sheets, SDS, are available on request.
We reserve the right to decline or defer a treatment if, in our operative’s professional judgement, conditions are unsuitable, for example high winds, heavy rainfall, frost, or drought stress, that could affect efficacy or safety. No charge will be levied for such deferrals.
3. Treatment Outcomes & Realistic Expectations
Whilst we take every care to deliver excellent results, lawn treatments are subject to natural and environmental variables. We cannot guarantee specific outcomes where results are affected by:
- Soil type, compaction, drainage conditions, or pH levels outside normal range
- Pre-existing lawn damage, disease, or weed resistance
- Drought, extreme heat, waterlogging, frost, or other adverse weather
- Client actions following treatment, for example early irrigation or mowing too soon
- Herbicide-resistant weed species
- Underlying issues such as fungal disease not disclosed prior to treatment
Where a treatment has not achieved the expected result due to factors within our control, we will return to re-treat at no additional cost, subject to agreement.
4. Cancellation Policy & Additional Charges
We understand that circumstances can change. However, to operate efficiently and fairly for all clients, the following cancellation terms and additional charges apply:
4.1 Cancellation Notice
A minimum of 48 working hours’ notice is required to cancel or reschedule an appointment.
Cancellation requests must be submitted in writing, via email or text message, during working hours. Requests received outside of working hours will be treated as received at the start of the next working day.
Example: A cancellation request received at 17:01 on a Friday will not begin the 48-working-hour notice period until 08:00 on the following Monday.
4.2 Short-Notice Cancellation / No Access Charges
Where a booked appointment is cancelled, rescheduled with insufficient notice, less than 48 working hours, or access to the lawn is not available at the time of our visit, Lawn Therapy reserves the right to apply a charge of:
- £10; or
- 25% of the treatment cost, whichever is greater
This charge is to cover the time, travel, and resources already allocated to your appointment.
4.3 Situations Where No Charge Will Apply
No cancellation charge will be levied in the following circumstances:
- Where 48 or more working hours’ notice is provided
- Cancellation due to bereavement of an immediate family member
- Where we have postponed the appointment due to unsuitable weather or ground conditions
- Where we have failed to attend without prior notice
4.4 Programme Cancellations
Treatment programmes and annual contracts cancelled part-way through the programme year may be subject to a proportional administration fee, and any outstanding balance for completed services will remain payable.
4.5 Additional Service Charges
To carry out treatments effectively, lawns must be clear of excessive debris, including leaves.
While our operatives may remove small amounts of debris at no extra cost, excessive leaf coverage will incur additional charges as follows:
Leaf Blowing Charges — Autumn, Winter, and Early Spring:
- Up to 5 minutes: no charge
- Beyond 5 minutes: £5 surcharge applies
- Additional time: £0.50 per extra minute thereafter
This approach ensures a fair and cost-effective method based on the actual time spent preparing your lawn for treatment.
5. Access to Property
You are responsible for ensuring our operatives have safe, unobstructed access to the lawn and treatment areas at the agreed appointment time. This includes:
- Ensuring gates are unlocked or access codes are provided in advance
- Removal of garden furniture, toys, or obstacles from treatment areas
- Securing pets indoors or away from treatment areas prior to and during the visit
- Informing us of any underground utilities, irrigation systems, or buried features
Where access is not possible at the agreed time, and we have not been notified with 48 working hours’ notice, the short-notice cancellation charge outlined in Section 4 will apply.
6. Damage & Liability
We take the utmost care when working on your property. However, the following terms govern our liability in the event of any damage occurring:
Our liability is limited to direct damage caused by our operatives’ negligence during a visit. We will not be held liable for pre-existing conditions, cosmetic variations in lawn appearance due to chemical reaction, or any consequential, indirect, or economic losses.
Where damage is alleged, you must notify us in writing within 7 days of the relevant visit. We reserve the right to inspect the alleged damage before accepting any liability. Claims reported outside this window may not be accepted.
We accept no liability for:
- Damage to underground pipework, cables, or irrigation systems not disclosed to us in advance
- Lawn discolouration, browning, or scorch arising from drought conditions or existing disease
- Damage caused by your failure to follow our post-treatment instructions
- Phytotoxicity resulting from spray drift where you have failed to remove sensitive plants from the treatment boundary
- Damage to third-party property where access was not clearly defined
Our maximum liability in any event shall not exceed the total value of the individual service visit during which the alleged damage occurred.
7. Insurance
We maintain the following insurance cover for all works carried out:
Insurance covers injury or damage to third parties or their property arising directly from our negligent acts or omissions in the course of providing services.
Certificates of insurance are available upon written request. We recommend that you also ensure your own property insurance is adequate and up to date. Our insurance does not replace or supplement your homeowner’s or building insurance obligations.
In the event of an incident, you must notify us immediately in writing. You must not admit liability on our behalf, alter the scene of any incident unnecessarily, or engage a third-party contractor to remediate alleged damage before we have had the opportunity to inspect and agree a course of action.
8. Payment Terms
Payment is due within 7 days of the date of invoice unless alternative arrangements have been agreed. We accept payment by bank transfer, debit card, and cheque. For ongoing treatment programmes, direct debit arrangements are available.
Overdue invoices will accrue interest at 8% above the Bank of England base rate in accordance with the Late Payment of Commercial Debts (Interest) Act 1998. We reserve the right to suspend further services pending settlement of outstanding balances.
9. Data Protection
We process your personal data in accordance with the UK General Data Protection Regulation, UK GDPR, and the Data Protection Act 2018. Your details are held securely and used solely for the purpose of administering your account and delivering services. We will not sell or share your information with third parties for marketing purposes without your explicit consent.
10. Governing Law & Disputes
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any dispute arising from or in connection with our services shall first be referred to informal resolution. If a resolution cannot be reached within 28 days, either party may refer the matter to mediation or the courts of England and Wales.
Nothing in these terms and conditions affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable UK legislation.
11. Amendments to These Terms
We reserve the right to update these terms and conditions at any time. Updated terms will be published on our website and, where a material change affects ongoing contracts, we will notify you directly by email with a minimum of 30 days’ notice. Your continued use of our services following notification constitutes acceptance of the revised terms.
